The U.S. Citizenship and Immigration Services has announced that the initial registration period for the fiscal year 2023 H-1B cap will open at noon Eastern on March 1 and run through noon Eastern on March 18, 2022. During this period, Finnan, Fleischut and Associates will be able to complete and submit registrations on behalf of your company using the USCIS online H-1B registration system.

We are required to use the myUSCIS online account to register each beneficiary electronically for the selection process and pay the associated fees for each prospective beneficiary. Registrants will be able to create new accounts beginning at noon Eastern on Feb. 21.

If the USCIS receives enough registrations by March 18th, 2022, they will then randomly select registrations and send selection notifications by March 31st, 2022. USCIS will conduct two lotteries to select enough beneficiaries to meet the 85,000 annual cap. The first lottery will include all registrations and they will select enough registrations to meet the regular cap of 65,000 selections. The second lottery will include U.S. advanced-degree holders who were not chosen in the first lottery. USCIS will select enough registrations to meet the advanced-degree cap of 20,000 selections. Finnan, Fleischut and Associates will then undergo the preparation and submission of H-1B petitions to USCIS for selected registrations starting April 1st, 2022. The filing period with USCIS will close no earlier than June 30th, 2022.
Please reach out to our office by February 14, 2022 to begin preparation on your H-1B CAP cases.
